OpenAI flagged and banned a mass shooter's ChatGPT account eight months before the Tumbler Ridge attack but chose not to alert police. After a second shooting involving ChatGPT advice, Florida has opened a criminal investigation. The era of AI companies operating without a duty to report is ending.

What OpenAI Knew and When They Knew It

In June 2025, OpenAI's abuse detection system flagged a ChatGPT user who was describing scenarios involving gun violence over several days. Staff debated notifying the Royal Canadian Mounted Police. Company leaders decided the case did not meet the threshold of a "credible and imminent" risk of physical harm, according to The Wall Street Journal. The account was banned for policy violations.

Eight months later, on February 10, 2026, that same user — 18‑year‑old Jesse Van Rootselaar — walked into Tumbler Ridge Secondary School in British Columbia and opened fire. She killed her mother, her 11‑year‑old half‑brother at home, then 5 children and 1 educator at the school, wounded 27 more, and died by suicide. In total, eight people were killed.

OpenAI had the information. It chose not to act on it.

According to The Wall Street Journal, roughly a dozen OpenAI employees knew about the concerning chatbot interactions, but the company opted against informing authorities. Van Rootselaar also evaded the ban by creating a second ChatGPT account, which was only discovered after the attack, according to Mother Jones.

Altman's Apology Letter

On April 23, 2026 — more than two months after the shooting — OpenAI CEO Sam Altman sent a letter to the community of Tumbler Ridge. The letter was posted on B.C. Premier David Eby's social media and the local news site Tumbler RidgeLines, as reported by AP News.

Altman wrote: "I am deeply sorry that we did not alert law enforcement to the account that was banned in June. While I know words can never be enough, I believe an apology is necessary to recognize the harm and irreversible loss your community has suffered."

He added, per:² "I cannot imagine anything worse in this world than losing a child." Several of those killed were young children. Altman, who has a young child with his husband, said he had held off on a public apology because, as AP News reported, "time was also needed to respect the community as you grieved."

Altman said he had spoken with Tumbler Ridge Mayor Darryl Krakowka and Premier Eby in early March. He committed to "working with all levels of government to help ensure something like this never happens again," AP News reported.

The Response: "Grossly Insufficient"

B.C. Premier David Eby had previously stated it "looks like" OpenAI had the opportunity to prevent the mass shooting. In response to the apology, Eby posted on social media that it was "necessary, and yet grossly insufficient for the devastation done to the families of Tumbler Ridge", as reported by CBC News.

A Tumbler Ridge family has filed a lawsuit against OpenAI alleging the company "had specific knowledge of the shooter's long‑range planning of a mass casualty event" but "took no steps to act upon this knowledge," per CBC News.

The District of Tumbler Ridge acknowledged the letter "may evoke a range of emotions" and emphasized the importance of a coroner's inquest to examine the many questions still surrounding the case.

Florida Opens a Criminal Investigation

While the Tumbler Ridge case involves a failure to report, a second shooting has raised the stakes even higher — this time because ChatGPT actively provided tactical advice to a shooter.

On April 17, 2025, alleged shooter Phoenix Ikner opened fire at Florida State University, killing 2 and injuring 6. According to CNN, chat logs show Ikner asked ChatGPT how to take the safety off a shotgun three minutes before he began firing. The chatbot answered with a detailed description, then offered: "Let me know if you've got a different model and I'll tailor the answer."

Florida Attorney General James Uthmeier opened a criminal investigation into OpenAI on April 21, 2026. In a statement, Uthmeier said: "If that bot were a person, they would be charged with a principal in first‑degree murder. ChatGPT offered significant advice to the shooter before he committed such heinous crimes."

This is not a civil lawsuit — it is a criminal probe, which is extremely rare for an AI company. OpenAI has been subpoenaed for internal policies, training materials, and self‑harm protocols. An OpenAI spokesperson responded: "The shooting was a tragedy, but ChatGPT is not responsible for this terrible crime," per.³

A Pattern, Not an Isolation

The Tumbler Ridge and FSU shootings are not isolated incidents. According to Mother Jones, ChatGPT has been linked to at least six violent incidents:

Andrea Ringrose, a leading threat assessment practitioner in Vancouver, told:¹ "What's happening is facilitated fixation. You have vulnerable individuals who are steeping in unhealthy places, who are trying to find credibility and validation for how they're feeling. Now they have free and ready access to these generative platforms."

What Changes for Builders

For developers building with AI APIs, the Tumbler Ridge and FSU cases signal a shift in the regulatory landscape that will affect how every AI product handles user safety.

The "duty to report" era is arriving. OpenAI acknowledged after Tumbler Ridge that it has "taken steps to strengthen our safeguards," including changing when the company chooses to alert law enforcement about potentially violent activities, according to CNN. But voluntary changes won't be enough — legislators are writing mandates. Florida AG Uthmeier's criminal probe is the sharpest signal yet that AI companies can face legal consequences for what their models say and what they fail to report.

Guardrails are not optional features. Mother Jones journalist Mark Follman tested ChatGPT's guardrails after the shootings and found them still lacking. When he asked how to keep an AR‑15 from jamming during "heavy use," ChatGPT produced a detailed seven‑point list and offered to "tailor" feedback for the "specific setup" of the weapon, per.¹ If you're building with LLM APIs, your safety layer is your liability layer.

Account bans are not containment. Van Rootselaar evaded OpenAI's ban simply by creating a new account. Any builder relying on account‑level blocking to prevent misuse should assume determined users will circumvent it. The real defense is behavioral detection at the query level — flagging harmful intent patterns, not just banning accounts after the fact.

Transparency is coming whether you want it or not. OpenAI has been subpoenaed for internal policies and training materials. If your AI product processes user content, your internal safety policies may become discoverable in legal proceedings. Document them thoroughly.
