- 05:00 - 05:30 uh what kind of chemical restrictions are allowed in your packaging and and end of life management and more here I wanted to pause and just touch base on what is epr I tend to do Dive Right into packaging epr and sometimes forget to explain what epr actually is so epr stands for extended producer responsibility it is a type of Regulation that really has become a go-to compliance op tool for governments
- 05:30 - 06:00 focused on uh circular economy and what extended producer responsibility really means is that there it's a regul regulation type which is putting more responsibility on producers so on those producers who are making the packaging brand owners who are putting the packaging on the shelves for consumers and so again it is doing exactly what the name implies really and the epr regulations are not only specific to
- 06:00 - 06:30 packaging they can be for used for lots of different types of products uh but they are again gaining a lot of popularity with packaging specifically and these types of regulations that focus on endof life management like what do you do with the product with the packaging at the end of its life do have a ripple effect up the EMP entire supply chain which makes them again very effective um because they are impacting or at least effective in the way that a
- 06:30 - 07:00 lot of stakeholders have to be involved uh with these sorts of compliance obligations and so our packaging epr Tool uh focuses again on package consumer product packaging Industrial Packaging and tertiary packaging and regulations that are again targeting those things it covers both existing and already in place regulations as well as forecasting for upcoming regulations uh our tool currently covers
- 07:00 - 07:30 130 jurisdictions across Asia Europe Middle East Africa and North America it does include all 50 US states and all of the Canadian uh territories and provinces the things that are out of scope are the tool the tool doesn't cover food contact regulations themselves though a lot of the packaging regulations we do cover also address food packaging so food packaging is included even if food contact regulations are not and then other things that are out of scope of the tool
- 07:30 - 08:00 are really just product specific regulations so the tool is specific for packaging itself and not the product inside the packaging right so we don't cover things like Transportation or Hazard communication because those are specific to the product and not the packaging right and so and then we are always working on improving and expanding our tool and so this year we are focused on expanding into Latin America and continuing to expand in uh
- 08:00 - 08:30 Asia and the AMA regions here is a list we always provide our existing customers about what specifically we are working on adding into the tool and I always again remind you all to or encourage you to if there's a country that's not on this list you see in front of you right now and not already existing in the tool that is a very high priority for you please let us know we are always flexible and willing to adjust uh what

- 10:30 - 11:00 said uh I hope the tool sounds very cool and exciting to you all as it is to me H but now we will dive into the real content of the webinar um and highlight the packaging and packaging waste regulations specifically so I will pass the mic over to you Kim thank you Melanie good morning good afternoon to everyone so I'll jump straight in um the packaging and packaging waste regulation as many of you will know is referenced also as the ppwr I'll be mentioning This Acronym
- 11:00 - 11:30 throughout so just so you know um so yeah many of you will be already familiar with some of its terms um this proposal work for a new regulation amending the directive was launched already in November 22 um sorry 20122 so the topic has been high on the agenda for everybody in working with packaging in Europe and last year the regulations were approved and are now published on the official Journal as regulation 20254 there are uh some adjustments from
- 11:30 - 12:00 earlier drafts in this final version so reuse and refill targets remain the same for example but the final regulation does provide specific exceptions for certain products such as wines and spirits milk so it has a bit more of a tailored approach we could say it entered into force on the 11th of February so just a month ago and it will start applying from August next year meaning most of its Provisions will become legally V ing from that date
- 12:00 - 12:30 however there is article 67 which will apply from February 2029 so this gives Industries extra time to transition away from what is expanded and extruded polystyrene EPs and XPS in food containers so this could be beverage cups shrink wrap luggage um poly stering chips multipack plastic which is commonly used in transport retail and food services so moving on uh to the
- 12:30 - 13:00 core measures I'm going to be presenting the ppwr introduces significant changes for companies producing or placing packaging on the EU Market these are recyclability postc consumer recycled content reduction of waste or minimization reusability labeling and registration and Reporting um the ppwr is laid out in 13 chapters and 70 articles um many of us have already become familiar with some of it and here
- 13:00 - 13:30 we'll be focusing with a bit of a limited time but we'll be focusing on sustainability requirements labeling and General Obligations I did want to give you a quick note though that the ppwr requires penalties to be effective proportionate and dissuasive but this interpretation uh of the terms may vary throughout different member states so we won't be delving into these enforcement mechanisms but if you want to have a closer look um it it does introduce several risk for companies once it's
- 13:30 - 14:00 fully implemented so please reach out if you do have any questions on that um moving on to scope and definitions here's where we will break down uh so you can see really whether it applies to your products or not the ppwr applies to packaging placed on the market in the European community and or packaging waste whether it is used or released at industrial commercial office shop service household or any level regardless of the material is us used so what it's introducing here is clear
- 14:00 - 14:30 distinction between what is considered packaging and what is not focusing on whether an item is an integral part of a product um and whether the there is an um it's necessary for its function throughout its lifetime so it aims to reduce unnecessary regulation of product components that serve a functional purpose that is in comparison to the directive um so there is three types of um Packaging uh we could have we have
- 14:30 - 15:00 the sales or primary packaging which is that packaging that comes directly into contact with the product this could be food contact sorry food containers shampoo bottles or toothpaste for example um there's also group uh or secondary packaging these a group of uh multiple units of primary packaging an example of this could be the sixpack plastic rings for cans there's also transport which could be uh pallets wrapped in plastic film large cardboard boxes containing multiple grouped
- 15:00 - 15:30 packages or polyene chips for cushioning for example this applies to economic operators and also producers producers are defined broadly as a manufacturer importer or distributor who regardless of the sales method that means including distance selling e-commerce Etc places the packaging on the market for the first time so that's the definitions there briefly for you moving on to um restricted substances um similarly to
- 15:30 - 16:00 the directive substances of concern and heavy metals are regulated under the ppwr and not much has changed however um recycled materials now must be meet stricter safety standards and we need to make sure that handful substances do not accumulate in recycled packaging so for heavy metals lead cadmium Mercury and exalent chromium um these must not exceed 100 people PM so that hasn't
- 16:00 - 16:30 changed but we might see stricter monitoring on these now to the juicy part uh pasas as always we do have the pp ppwr uh limiting the amount of pasas in food contact packaging so this will mean that it will be prohibited from sale if it contains two 25 parts per billion for any pasas as measured with targeted pasas analysis or 250 uh parts per billion for the sum of pasas this is referring to polymeric
- 16:30 - 17:00 pasas ex which would be excluded from uh quantification pasas compounds that exist as polymers which are larger more complex molecule molecules are typically less volatile and they're not easily measured with a standard targeted analytical method so these kind would be excluded from these two measurements here then there's a 50 PPM limit for pases in general that's including the polymeric pasas and if the total Florine content is uh equal or exceeding 50 ppms
- 17:00 - 17:30 the manufacturer importer or Downstream user must provide the relevant party uh with proof of this Florine content so another aspect in terms of uh restricted substances would be BPA or bisphenol a this is regulated under a separate regulation uh restricting its use in food contact materials and articles such as baby bottles however the ppwr does extends sustainability and
- 17:30 - 18:00 safety requirements to packaging containing this substance so the use of BPA and its salts is prohibited in the manufacturer specific fcms and other bisphenols or bisphenol derivatives must not contain any residual vpa so that's one of the things to consider there now let's move on to the design aspects um there's a few chapters to this uh a few articles on this so going to start off with minimization reduction under the ppwr packaging must be
- 18:00 - 18:30 designed to minimize volume and weight while maintaining the functionality and recyclability features that merely increase perceived volume such as double walls or falce bottoms or superflous packaging are not permitted anymore um so the technical documentation for packaging must justify this minimum necessary weight and volume detailing calculations batch variations and design constraints that prevent further reduction um must explore all weight
- 18:30 - 19:00 reduction opportunities this means avoiding any uh mere material substitution and if there is an increased weight or volume Um this can be accepted if it's justified by other aspects of design such as recyclability recycled content or reusability so yeah there's a lot to impack in there but um please reach out if you have any questions um I'll move on to recyclability as uh kind of short
- 19:00 - 19:30 of in time so I'll move on to recyclability there we go um all packaging is must be intended and designed so that once it becomes waste it is suitable for material recycling that means that it must be easily collected separately it must be easily sorted into designated waste streams without contaminating them and it must be recycled at scale so here the ppwr aims to standardize recyclability criteria across the EU to create a Level
- 19:30 - 20:00 Playing Field and eliminate Market barriers so packaging will be rated in what is known as a b or c based on a harmonized recycling design criteria you can find this in Annex 2 tables three and four uh the packaging design must prioritize the predominant material used in the packaging for this effective recyclability and so here's a few deadlines that you must keep in mind we have from 2030 Packaging must meet this criteria to be considered
- 20:00 - 20:30 recyclable um however 20 from 2035 additional criteria based on large scale recycling outcomes will be introduced and packaging rated below c will no longer be considered technically recyclable and finally from January 2038 uh only packaging that achieves Grade B can be placed on the market so we'll need to be really getting start to get acquainted with this criteria and know how it's going to affect um uh
- 20:30 - 21:00 the supply chain really the provision also establishes a framework for adjusting the financial contribution that producers pay based on the recyclability performance grades so it depending on how well the packaging achieves this um these grades so in this way it's linking producers economic responsibility to how well their packaging is designed for recycling something which I think is is quite interesting moving on we we have the Recycled content next
- 21:00 - 21:30 um uh packaging should be designed and manufactured for a greater substitution of what would be the primary raw materials with recycled ones so there's a strong focus on plastic here obviously the Recycled content must be recovered from postc consumer plastic waste that is collected either within the EU or a third country provided that collection standards are equivalent then by 2030 plastic packaging must meet these mandatory recycling content targets you
- 21:30 - 22:00 can see um these are calculated per manufacturing plant and year giving a bit of flexibility um with stricter targets that will be introduced by 2040 and these are based on packaging type and contact sensitivity so that means whether it becomes sorry it comes into contact with food medical products and so on so just to give you an example here um single-use plastic beverage bottles have a target of 30% % uh recycled by 2030 and it go already goes
- 22:00 - 22:30 up to more than twice of that 65% by 2040 um so yeah another thing to keep in mind there moving on to the other aspect of design which is also quite important is reusability reuse under the ppwr means any operation by which reusable packaging is used multiple times for the same purpose for which it was conceived so it must meet again specific criteria
- 22:30 - 23:00 which is laid out in article 11 you can go check that um this may mean that packaging needs to be heavier or larger uh than if it was only designed to use less material so you can see that there will be some compromises we'll have to do there in terms of design so this could mean for example um that packaging may need to be sturdier to withstand multiple cycles of use so that's something that we need to consider when when designing um achieving a higher
- 23:00 - 23:30 percentage of recycled or monom material composition may require certain design trade-offs and certain design choices that improve recyclability might need also larger and heavier package um so yeah the ppwr establishes progressive reuse obligations allowing sector specific exemptions and it's also giving member states flexibility to set stricter targets if if if they so wish to so again um as I was mentioning with
- 23:30 - 24:00 enforcement there are certain rules that are uh catch all but there are there is some flexibility for member states there to uh tailor it so giving you some examples and this is not an exhaustive list um we have reused targets for transport and sales packaging where by thir 2030 at least 40% of Transport packaging in the EU must be reusable and it's increasing this uh Target to 70% by 40 at 2040 so this would be um stricter
- 24:00 - 24:30 rules for packaging used within an operator's site at a single member Sate but there are exemptions in this case for example for dangerous goods or L large uh Machinery packaging food contact flexible packaging and cardboard boxes um another aspect I wanted to exemplify here is group packaging so we have a target of 10% of group packaging um by 2030 and this is uh then increased to 25% by 2040 in the case of Beverage
- 24:30 - 25:00 packaging for example we have a target of 10% of alcoholic and non-alcoholic beverages that must be sold in reusable packaging and it's increased to 40% by whoops 2040 um exemptions apply here to certain perishable dairy products Wine and Spirits so keep that in mind another important aspect is that if you are a small retailer or are in a small uh
- 25:00 - 25:30 sorry remote location uh you might want to pay attention to certain exemptions that you can apply so and then finally yeah be aware that the commission will issue some guidelines on these um products by 2027 um and also the commission plans to review the effectiveness of the 2030 targets by 2034 and assess the feasibility of the 2040 targets so that's also something we must keep in mind if we want to see whether it
- 25:30 - 26:00 changes or not in in the near future moving on to the last aspect of our design is the biobased and compostability so biobased um so yeah sorry by 2028 um the EU will review the sustainability and performance of biobased uh plastic packaging potentially leading to new legislation on sustain sustainability criteria usage targets and alter ative compliance for recycled content in food packaging um
- 26:00 - 26:30 but yeah so far the biobased Plastics definition is Plastics that are made from biological resources such as biomass feed stock organic waste or byproducts irrespective of whether the plastic is biodegradable or not now we delve into what's the biodegradable Plastics and this definition is quite key here so it refers specifically to those Plastics that are readily biodegradable meaning they can convert more than 90% of the original material
- 26:30 - 27:00 into CO2 water and minerals by via biological processes within 6 months so this is regardless of the feed feed stock that is used but it's an important aspect to maintain to keep in mind and it's a way of harmonizing um across the EU the ppwr also establishes mandatory compostability for tea and coffee bags as well as Ticky labels on fruit and vegetables by February 2028 and this is under certain industrial
- 27:00 - 27:30 conditions ensuring that they can be processed effectively in bowte treatment facilities um member states again here may rule additional packaging to be compostable if their Waste Systems Support biase collection and processing we know that there are some differences in these systems across uh Europe so um yeah if these conditions are met they can require lightweight plastic bags for example to be compostable so another thing to check with within the member states you are placing your packaging
- 27:30 - 28:00 in um and finally we'll move on to the labeling uh aspects next slide um so yeah here we have the 2028 um deadline for packaging where it must have harmonized labeling indicating material composition for Consumer sorting so the whole idea here is that consumers have a very clear idea of what they need to do with their packaging um
- 28:00 - 28:30 so packaging labels will use pictograms for accessibility for people with disabilities and will be paired with corresponding labels on waste bins so trying to reduce as maximum that that possible confusion there they will include digital marking for substances of concern and compostable and deposit return system packaging must be clear and unambiguous label the epr compliance can also be shown via QR codes and claims on recycled and biobased
- 28:30 - 29:00 content must follow eu-wide rules again there is really a lot to impact in these um definitions here but uh please reach out if you want to know more uh by 2029 February or 30 months from the entry into force of the relevant implementing acts this is something that the mechanism that the EU often uses so implementing certain aspects of Regulation via implementing acts um we have reusable packaging placed on the market that will be um that that is
- 29:00 - 29:30 labeled reusable and distinguished from single use packaging so this is to help consumers immediately recognize them and there are exemptions for e-commerce packaging for example and transport packaging and packaging and deposit return systems um so we do not have a lot of time to go into claims but that is covered under article 14 and it basically aligns uh environmental claims about packaging with unfair commercial practices directive so so you can go check that if you wish then in terms of
- 29:30 - 30:00 um registration in the next slide please the ppwr requires each member state to appoint a competent Authority or multiple by July this year to oversee the implementation and enforcement of producer registration and this applies in general to any producer that places packaging or package products on the market in a member State for the first time um by February next year year the commission will Define what is called a
- 30:00 - 30:30 standard registration format that uses Open Standards and machine readable data and allows data transfer without vendor lockin producers must be registered in a member in the member state where they place the packaging or package products on the market but if a if you as a producer are not established in the EU then you must appoint what is called an authorized representative an AR in that member state that is covered under article 45 if you want to see more and
- 30:30 - 31:00 finally reporting some of the general reporting obligations are addressed in the pbwr but ultimately you must refer to each individual member state to see the specific requirements again here there are some exceptions for small producers so if you're um producing under 10 tons of packaging per year you can submit what is known as a simplified report okay so I know this is a very brief overview and there is really lot to apart from this regulation but please

- 31:30 - 32:00 things going on elsewhere in the world so that's that's where we're at now so we'll start with Asia Pacific uh where there's been some movement last year and already at the beginning of this year with um the current plastic waste management rules uh the current rules were put out in 2016 I believed and they are geared towards plastic packaging specifically but there are two different drafts um that are going on so we have the Draft rules to extend um the epr
- 32:00 - 32:30 obligations Beyond just plastic packaging and to include glass metal and paper so these some some Draft rules have been introduced uh so if you are uh impacted by that you may want to take a peek and then there have also been some amendments introduced to the existing regulation uh which would require QR code labeling for the plastic packaging specifically starting as early as July of this year in South Korea um there has been a draft
- 32:30 - 33:00 amendment to their act on the promotion of saving and recycling of resources uh these amendments uh propose making PCR content um mandatory and which it is currently voluntary and um so yeah so that just indicates that in the near future this this could become an enforced uh regulation so if you are currently not aware of those voluntary requirements you may want to
- 33:00 - 33:30 take a look at them and investigate how the possibility of them becoming mandatory could impact your business jumping to Europe Middle East and Africa uh in Kenya we have uh under the sustainable Waste Management regulations coming up in May all producers must be registered with the national environment and Management Authority there and in Russia there are some annual reports that are due in April so coming up here shortly um which
- 33:30 - 34:00 they're not a brand new obligation the reports themselves are not a new obligation but there are some new reporting forms available so they've broken down um there's now three different reporting forms I believe uh and it's divided up based on whether the packaging is being imported um and then there's a new procedure for calculating the environmental fees so again even though the reporting obligation itself isn't new there are some new aspects of it uh that you may need to uh
- 34:00 - 34:30 investigate and then we also have in the UK uh their producer responsibility obligation regulation became effective at the beginning of this year and reporting for that is also due um in April for the second half of 2024 I believe that's a typo there um but Scotland has also proposed amendments to its existing deposit and return scheme uh while the UK's specific regulation
- 34:30 - 35:00 itself is being delayed and then uh the separate the separate of waste England regulations 2025 also comes into effect at the end of this year so that one has to do with um it's supposed to be the separation there we go of waste uh regulation and it's about again how um paper and cardboard should be separated from other dry recyclables and how that regulations outlining how that is supposed to be
- 35:00 - 35:30 approached in Canada uh this is a throwback just a reminder that last year um the federal plastic registry reporting notice was signed and so the phase one reports under that regulations are due this September um this phase does address P Plastics uh placed on the market in 2024 in three categories so the reporting notice itself has multiple phases for reporting so this is just phase one and so phase one addresses P plastic
- 35:30 - 36:00 packaging uh plastic involved in electronic and electrical equipment and single use or disposable plastic packaging Plastic Products phase two reporting which will be due in 2026 uh will build on this right so this if you um have reporting obligations under phase one then when Phase 2 comes around you'll have to keep reporting on those same things as well as additional things right so each phase builds and
- 36:00 - 36:30 more and more will be due uh I believe there are four phases to that reporting uh so you'll want to make sure you have all of that ready to go starting in September and then in the US uh there are five states with full epr regulations in place for packaging and there really is movement going on with all of them so if you're dealing with packaging in the US states you'll want to keep an eye on what's happening with these um in May we're anticipating some final rule adoption for their regulation
- 36:30 - 37:00 later this year um producers in both Oregon and Colorado have to become members of the state appointed uh producer responsibility organization by July and then Cal recycle uh has published some updates to their covered materials categories so which types of packaging are actually in scope uh you'll want to take a look at that and then uh just a note at the bottom that the circular action Alliance is the state PR that has been approved um in both Oregon
- 37:00 - 37:30 and then recently in Minnesota um and it is again also in Colorado as well so the circular action Alliance is an organization uh that you'll need to be involved with for compliance in those States and then um on a forecasting note in the US uh we have another tool internally where we're tracking uh again types of bills that are being introduced at the state level that are impacting chemicals and in chemicals management and so I just wanted to bring to your attention that about 10% of the bills we
- 37:30 - 38:00 are tracking so far this year are targeting packaging in some way shape or form so this packaging really is a high priority for the US states uh some examples are just that Massachusetts signed at the end of last year a clean energy bill requiring a special epr commission to be formed so even though again no specific packaging APR there yet this this indicates that there could be one coming in the future uh New York
- 38:00 - 38:30 has an open-ended epr bill which has everybody which I think everyone's keeping an eye on just because they haven't defined what designated products means yet so will they target do they have a desire to Target packaging under this or some other type of product we're not sure yet but something to keep an eye on and then Washington State uh has also introduced a epr program for packaging uh draft bill so they are also looking
- 38:30 - 39:00 at that and um it would make sense uh for what we know about Washington that they would pursue this kind of Regulation obligation uh they tend to you know align with some of what the other states are doing around them Oregon California Washington they tend to kind of align their bills sometimes when they can so since Oregon and California both have epr for packaging regulations in place it just makes sense uh for from my perspective that Washington might also um PS uh pursue

- 44:00 - 44:30 um and are there harmonized symbols we can Implement now or do we still need to use symbol specific for each member state so this I think sorry will be concerning a few other um atende today so the harmonized recyclability symbols are still a few years away that's expected in 2027 under the ppwr so you will need to continue using the recycling symbols that are speciic specific to each member state for now and so different member states have
- 44:30 - 45:00 their own requirements for packaging symbols um and they're based on the local recycling systems and regulations that they have but once the harmonized recycl recyclability symbols are introduced then you can transition to using those but unfortunately we do not have those available just yet so that would be one question I picked then there's another one on pasas so with regard to pasas restrictions in the EU there is information available relating to food food contact packaging but do
- 45:00 - 45:30 you know how other types of packaging might be treated um so yeah I think this again uh can be uh relevant to others so while in the there is detailed information regarding food and food contact packaging uh the treatment of other types of packaging is still subject to regul regulatory discussions uh we are expecting uh pus ban under reach and that is still on the go so yeah that that is something we'll
- 45:30 - 46:00 we'll still have to wait for and see um I think it's likely that restrictions on beas will extend to other packaging materials particularly those that are used for Cosmetics uh for chemicals or other consumer goods especially as these substances can be harmful to human health so I think those would probably be areas where we'd want to look at um and a third question I picked was um I saw a couple of people asking about medical device packaging yeah and what it's exempt from the ppwr so the medical
- 46:00 - 46:30 device packaging is exempt from certain aspects of the uh ppwr due to the specific needs of this um this type of of devices um so the medical sector where the packaging's primary purpose is to say preserve and protect a device rather than to reduce environmental impact and um yeah these would be would not have to meet the recyclability criteria that apply to other types of packaging uh but it still needs to comply with General waste
- 46:30 - 47:00 management requirements um so yeah I think that covers three different aspects I see a few bits and Bobs of um on substances but I think we can address those in a different moment I don't know Melanie if you want to take some questions from your section yeah so one of the questions I saw come through is a great question which I should have addressed which is just how you access our packaging epr tool and so

- 49:30 - 50:00 anything going on with Latin America implementing anything similar I've have um no idea at this point no um I mean I do think that um there is a tendency to sort of um replicate some of these um strategies in in terms of policymaking and and it's likely that um we'll see this in fact I was reading an article this morning on the uh impact of Bea restriction in in the packaging regulation and how it's
- 50:00 - 50:30 impacting the US already but I can't say the same for Latin America I know that they are perhaps slightly behind in terms of regulating these these aspects yeah no no like I said thank thanks for that Insight I know that Latin America is a focus for us this year on expanding our content and the tool into that region so hopefully we'll be able to provide you those insights uh more in depth throughout the year maybe one of our quarterly webinars can focus specifically on Latin America that would
